1. Acceptance of Terms

By accessing or using Secret Book Price ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use this Service. If you are under 18, you may only use this Service with the involvement and consent of a parent or legal guardian.

2. Description of Service

Secret Book Price provides a textbook price comparison service that aggregates buyback offers from multiple vendors. Our Service allows users to:

• Scan book barcodes to retrieve ISBN information
• Compare buyback prices across multiple vendors
• Access historical pricing data (for registered users)
• Save and manage book lists

3. Service Availability

No Guaranteed Uptime: We strive to provide reliable service, but we do not guarantee that the Service will be available at all times. The Service may be unavailable due to:

• Scheduled or unscheduled maintenance
• Third-party vendor API outages or changes
• Network or infrastructure issues
• Force majeure events (see Section 15)

Vendor prices may become temporarily or permanently unavailable if vendors modify their systems, discontinue their services, or block our access. We will make reasonable efforts to maintain vendor integrations but cannot guarantee any specific vendor's availability.

4. User Accounts and Tiers

4.1 Account Types

• Guest (Anonymous): Up to 5 scans per day without registering
• Bronze Tier: 25 scans per day for basic subscribers
• Silver Tier: 100 scans per day for standard subscribers
• Gold Tier: Unlimited scans and advanced features for premium subscribers

4.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

5. Subscription and Billing Terms

5.1 Free Tiers

Guest and Bronze tiers are currently provided free of charge. We reserve the right to introduce fees for these tiers with 30 days' notice.

5.2 Paid Tiers

For Silver and Gold subscription tiers (when available):

• Billing Cycle: Subscriptions are billed monthly or annually, as selected at signup
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled
• Price Changes: We may change subscription prices with 30 days' notice before your next billing cycle
• Cancellation: You may cancel at any time. Cancellation takes effect at the end of your current billing period

5.3 Refund Policy

Paid subscriptions are generally non-refundable. However, if you experience a significant service issue, contact us within 7 days at support@secretbookprice.com to discuss your situation. We may, at our discretion, provide a pro-rated refund or service credit.

6. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of any laws
• Attempt to circumvent rate limits, scan limits, or other usage restrictions
• Scrape, crawl, or use automated tools to extract data without permission
• Interfere with or disrupt the Service or servers connected to it
• Impersonate another person or entity
• Share your account credentials with others
• Use the Service to collect or harvest personal information of other users

7. Price Information Disclaimer

IMPORTANT: The price information displayed on our Service is provided for informational purposes only.

• Prices are obtained from third-party vendors and may change without notice
• We do not guarantee the accuracy, completeness, or availability of any price
• Actual buyback prices may differ from displayed prices
• Vendors may have additional conditions, restrictions, or requirements
• We are not responsible for any transactions between you and third-party vendors

Always verify prices directly with vendors before completing any transactions.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Secret Book Price and is protected by copyright, trademark, and other intellectual property laws.

Price information and vendor data are the property of their respective owners. We display this information under fair use principles for price comparison purposes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the greater of: (a) the amount you paid us in the last 12 months, or (b) $100

10. Indemnification

You agree to indemnify and hold harmless Secret Book Price and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any transactions with third-party vendors

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Abusive or fraudulent behavior
• Requests by law enforcement
• Extended periods of inactivity (12+ months)

Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Dispute Resolution and Arbitration

12.1 Informal Resolution First

Before initiating any formal dispute resolution, you agree to contact us at legal@secretbookprice.com to attempt to resolve any dispute informally. We will work with you in good faith to resolve the matter. This informal dispute resolution process must be completed before either party may initiate arbitration, and must take no longer than 30 days unless both parties agree to extend.

12.2 Binding Arbitration

If we cannot resolve a dispute informally, you and Secret Book Price agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration, rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights.

Arbitration Rules: The arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures, or by another mutually agreed arbitration provider. The arbitration will take place in Delaware or, at your election, will be conducted remotely via video conference.

Costs: Each party will pay its own attorneys' fees and costs, unless the arbitrator determines that a party's claim or defense was frivolous. For claims under $10,000, we will reimburse your filing fees and pay arbitrator fees.

12.3 Class Action Waiver

YOU AND SECRET BOOK PRICE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and we agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

12.4 Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to legal@secretbookprice.com within 30 days of creating your account. Your notice must include your name, email address, and a clear statement that you wish to opt out of this arbitration agreement. If you opt out, you may pursue claims in court.

12.5 Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by:

• Email: Sending notice to registered users at least 30 days before changes take effect
• In-App Notice: Displaying a prominent notice when you next use the Service
• Website: Posting the updated Terms on this page and updating the "Last Updated" date

For non-material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, epidemics, strikes, labor disputes, power outages, internet service provider failures, third-party vendor service interruptions, or shortages of transportation, facilities, fuel, energy, labor, or materials.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Secret Book Price regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
